Tipperary solicitor hits out at how cancer misdiagnosis case was defended

Cashel solicitor Cian O’Carroll has called for a ‘little more human decency’ in medical negligence cases following the settlement of a case in the High Court involving a Tipperary woman who had been misdiagnosed for breast cancer.
The HSE has apologised to Olive Fahey, Littleton, County Tipperary whose breast cancer was misdaignosed three times over a 19-month period and who had to undergo a mastectomy when invasive cancer was eventually diagnosed.
Mrs Fahey had sued the HSE, Barrington’s Hospital in Limerick and two consultants.
The case was settled on Thursday but details of the settlement were not disclosed.
Speaking after the settlement, Mrs Fahey’s solicitor Cian O’Carroll - a regular columnist in ‘The Nationalist’ - said a little more human decency and sincerity was needed in such cases and a bit less law.
He criticised the way the case had been defended, which was an extra ordeal for Mrs Fahey and her husband over a five year period.
As a result they had to surrender their privacy and Mrs Fahey’s anonymity to go to court.
