Two appear in court following Clonmel death
Two Clonmel men have been remanded in custody accused of assaulting a man whose body was found in the stairwell of a local apartment block last week.
Dungarvan District Court was told that more serious charges are likely to follow.
John Hannigan (44) of River House, Clonmel, Co Tipperary and Joseph O’Riordan (38) of Inis Óir, Cashel Road, Clonmel were both brought before Dungarvan district court on a charge of assaulting Anthony Fallon (46), causing him harm, on January 18 last in Clonmel.
Mr Fallon, a father of two, was found dead in the River House apartment block on Clonmel’s New Quay at about 6.45am that morning.
Inspector Paul Heffernan said the charge of assault causing harm had been directed by the DPP’s office, but final reports have yet to be considered, including the report of the state pathologist, and then “it’s likely that more serious charges may be preferred”.
Judge Terence Finn remanded John Hannigan in custody with consent to bail, on his own bond of €1,000 and an independent surety of €6,000. If he made bail, the accused was to reside at his River House address at all times; observe a curfew between 10pm and 7am; sign on daily at Clonmel garda station; stay away from anyone associated with the case; and surrender his passport.
The issue could be re-visited if more serious charges were put against the accused, the judge said.
Gardai told the court that neither man made any reply when they were charged on Tuesday evening of last week at Clonmel garda station.
Solicitor for Joseph O’Riordan, Dermot O’Brien, said he was not applying for bail. Judge Finn remanded Mr O’Riordan in custody.
Both accused are to attend a special sitting of Clonmel district court on January 31.
Free legal aid was granted in both cases after the court heard the two men were on social welfare.
